The Prosecuting Attorney’s Office Accomplishments

  • Eliminated a two and half year back log of criminal cases
  • More than doubled the number of indictments from 2008 to 2009
  • Doubled the number of convictions from 2008 to 2009
  • Created a Justice Without Delay Policy to indict cases within 30 days (previously took 6 to 8 months)
  • Saved more than $500,000 in the jail bill by reducing the number of days defendants are in jail pre-indictment
  • Established a new delinquent tax and worthless check policy that collected over $1,000,000 for Kanawha County
  • Doubled the conviction rate of misdemeanors
  • Streamlined misdemeanor dockets in Magistrate Court by establishing new discovery policy
  • Saved thousands of tax dollars and maximized the number of officers on the street for public safety by avoiding law enforcement daily attendance in Magistrate Court.
  • Created a Truancy Reduction Initiative to get elementary kids back in school and attack juvenile crime.
  • Established a Victim Services Division to provide services and support to victims of crime and witnesses to crime.
  • Established a Kanawha County Victim Services Center consisting of over a dozen different organizations to comprehensively serve the unique needs of victims of domestic abuse

The Prosecutor’s Office

Our office prosecutes crime in Kanawha County and supports victims of crime. We have over 40 employees working everyday to serve the people of Kanawha County and fight crime. We are made up of prosecutors, victim advocates, investigators, and support staff. Our office works closely with various law enforcement agencies that investigate crime. The Prosecutors office is contains three major divisions: the Circuit Court Division, the Magistrate Court Division, and the Victim Services Division.

Circuit Court Division

This division prosecutes felony offenders in Kanawha County Circuit Court. These attorneys handle all pretrial hearings/motions, conduct witness and victim interviews, and prepare the case for trial. These trial attorneys are assigned to the following circuit court judges:

Magistrate Court / Juvenile Division

This division prosecutes all misdemeanor cases in Kanawha County Magistrate Court. Generally, misdemeanor offenses are less serious than felony offenses and carry a maximum of one year in jail. There are 4 assistant prosecuting attorneys who are responsible for all pretrial hearings/motions, conducting witness and victim interviews when necessary, and preparing for trial. There are 10 magistrate court judges in Kanawha County. One magistrate, hears all preliminary matters involving juvenile respondents. There are 2 assistant prosecuting attorneys who prosecute juvenile offenders.
